This article provides a high-level guide to the divorce process in South Africa to help you understand what to expect and how to prepare and how our divorce lawyers can assist.
- Legal Grounds for Divorce in South Africa
South African divorce law is governed by the Divorce Act 70 of 1979. The Act permits divorce based on the irretrievable breakdown of the marriage, mental illness or continuous unconsciousness of a spouse. The most common ground cited is irretrievable breakdown, which can be evidenced by:
- Living separately for a continuous period of over one year;
- Physical or emotional abuse;
- Incompatibility or loss of mutual affection;
- One of the parties or both simply does not want to proceed with the marriage.
- Types of Divorce: Uncontested vs Contested
Uncontested Divorce
An uncontested divorce occurs when both spouses agree on all major issues such as child custody, maintenance, division of property etc. This is the simplest, fastest, and most cost-effective method. Our divorce lawyers in Pretoria and Cape Town are conveniently located near you and can help you finalise the process swiftly and cost-effectively.
Contested Divorce
A contested divorce arises when parties cannot reach agreement and the divorce must go on trial. Such matters can take years to finalise, especially when minor children or complex financial disputes are involved. This is a very expensive process and is not recommended.
- Step-by-Step Breakdown of the Divorce Process
Step 1: Engage with one of our specialist divorce attorneys in Pretoria or Cape Town—either online or in person—to understand your rights, obligations, and strategic options.

Step 2: Issue and Serve the Summons
Once the decision is made to proceed, one of our divorce lawyers in Pretoria or Cape Town will draft and issue a divorce summons. If you are based in any other jurisdiction countrywide, our divorce attorneys will appoint a correspondent attorney. The summons outlines the relief you seek, such as an order of divorce, custody of the children, maintenance of the division of the estate etc.
If the parties have already reached a settlement at this stage, one of our divorce attorneys will draft the settlement agreement which is in most instances attached to the summons in order to simplify matters.
The summons must be served personally on the defendant by the sheriff of the court.
Step 3: Defendant’s Response
Should the defendant want to oppose the divorce, he/she has in general 10 business days to file a Notice of Intention to Defend. If no such notice is filed, the divorce is uncontested at that stage and one of our divorce attorneys will proceed to set the matter down on the first available date on the unopposed roll.
Step 4: Discovery and Pleadings
In contested matters on the other hand, pleadings will be exchanged and documents must be discovered, which may include discovery of bank records, asset disclosures, and expert reports.
Step 5: Mediation
Courts increasingly encourage mediation before proceeding to trial. Our firm provides expert mediation services in Cape Town and Pretoria to facilitate amicable settlements.
Step 6: Trial and Finalisation
If no settlement is reached, the matter proceeds to trial. After hearing evidence from both parties and experts, the judge grants a decree of divorce and makes orders regarding children, maintenance, division of property etc.
If you’re based in Pretoria or Cape Town, our local divorce attorneys are intimately familiar with the High Court and Regional Court procedures and judiciary practices. If you are based in any other centre countrywide, our divorce lawyers will still drive the process through appointed correspondents.
- Divorce with Children Involved
When minor children are involved, the Children’s Act 38 of 2005 mandates that the best interests of the child prevail. A parenting plan may be developed, and the Family Advocate’s Office will assess the arrangement before court approval. Custody, contact (access), and maintenance arrangements must be carefully considered.
Our divorce lawyers offer compassionate and child-centric advice to minimise the emotional impact on families.
- Financial Considerations: Costs and Maintenance
While uncontested divorces may cost as little as R10,000.00 – R25,000.00 the costs of contested divorces can run much higher depending on complexity. Maintenance (spousal and child) is assessed based on need and ability to pay.
Our divorce attorneys in Cape Town and Pretoria work to resolve maintenance disputes swiftly, leveraging experience in high-conflict financial matters.
