Our attorneys represent our clients during the entire divorce process. This includes instituting and opposing divorce proceedings, applications for interim maintenance and care and attending to settlement negotiations on behalf of our clients.

We ensure the skillful drafting of divorce settlement agreements which typically deal with the proprietary consequences of a divorce, spousal maintenance, maintenance for children and custody of and access to the children.

As part of this process, we also ensure that settlement agreements adequately deal with:

  • the award of pension interests as contemplated in the Divorce Act 1979;
  • the registration of immovable property pursuant to a divorce; and
  • the registration of mortgage bond substitutions should such immovable property be mortgaged.

 In doing so, we take great care in ensuring that settlement agreements accurately reflect the parties’ intentions, avoiding the necessity to sign additional documentation after the divorce to amend settlement agreements or to approach a court to amend divorce orders.
